TERMS OF SALE
These terms of sale are concluded between the company MOMUS and www.momus-paris.com, a simplified joint-stock company (SAS) with a capital of €90,000, whose registered office is located at 70 rue du Rendez-Vous, Paris, and registered with the Paris Trade and Companies Register under number RCS Paris 900 569 807 00010, hereinafter referred to as MOMUS, and any natural or legal person wishing to make a purchase via the MOMUS website, hereinafter referred to as the buyer.
Purpose: These terms aim to define the contractual relationship between MOMUS and the buyer, and the applicable conditions for any purchase made via the MOMUS online store, whether the buyer is a professional or a consumer. Any purchase through the site implies full and unreserved acceptance of these terms. These terms prevail over any other general or specific conditions not expressly approved by MOMUS. MOMUS reserves the right to modify its terms at any time, with the applicable version being the one in force at the time of the order.
Products and Services: The items offered are those listed in the online catalog. These products are available within the limits of stock. Each product comes with a description provided by the supplier. Product photos aim to be as accurate as possible but cannot guarantee perfect similarity.
Prices: The prices shown are in euros, inclusive of VAT as applicable on the day of the order. Any change in VAT may impact prices. MOMUS reserves the right to adjust prices at any time, but the applicable price is the one shown at the time of the order. Online sales of consumable products are available to customers residing in France.
Subscriptions: The customer subscribes to a monthly box for an indefinite period. The subscription can be cancelled at any time and ends the month following the cancellation. Monthly billing applies. The customer will receive two, four, or six coffees each month (depending on the chosen plan). Delivery is included in the subscription price.
Orders: Order confirmation implies acceptance of the terms of sale, acknowledgment of full understanding, and waiver of other terms. The order confirmation serves as proof of the transaction and will be acknowledged by email.
Withdrawal: Buyers who are non-professional individuals have a right of withdrawal of seven days from delivery to return the product for exchange or refund, excluding return shipping costs. The right of withdrawal does not apply to coffee and other consumables, per Article L121-21-8 of the French Consumer Code: “The right of withdrawal cannot be exercised for contracts: […] 4° For the supply of goods likely to deteriorate or expire quickly; 5° For the supply of goods unsealed by the consumer after delivery and not suitable for return for health or hygiene reasons.”
Payment: Payment is due at the time of the order. Accepted cards: Carte Bleue, Visa, MasterCard. Payment via PayPal is also possible. MOMUS does not store credit card details. The buyer's account is charged upon ordering. An invoice including VAT can be sent upon request.
Delivery: Deliveries are made to the address indicated at the time of the order, within the agreed delivery zone. Risks pass to the buyer once products leave MOMUS premises. In case of damage during transport, claims must be made to the carrier within three days. Delivery times are indicative; beyond 30 days, the buyer may cancel the sale and be refunded.
Guarantee: All products are covered by the legal guarantee under Articles 1641 and following of the Civil Code. Non-compliant products may be returned for exchange or refund. Claims must be made by email at service@momus-paris.com or by mail to MOMUS, 70 rue du Rendez-Vous, 75012 Paris, within 30 days after withdrawal.
Liability: MOMUS is only bound by a best-effort obligation. It is not liable for damages related to internet use, such as data loss, intrusion, virus, service interruption, or other involuntary issues.
Intellectual Property: All content on the MOMUS site remains the exclusive property of MOMUS. No one is authorized to reproduce, exploit, or redistribute, even partially, any site content without prior written consent.
Personal Data: In accordance with the Data Protection Act of January 6, 1978, buyers’ personal data may be subject to automated processing. By using the site, you consent to MOMUS collecting and using your data in accordance with its privacy policy. The processing of personal data was declared to the CNIL on May 25, 2019, under number 2195286.
Archiving: MOMUS will archive orders and invoices on a reliable and durable medium, serving as a faithful copy per Article 1348 of the Civil Code. These records will serve as proof of transactions between the parties.
Dispute Resolution: These online sales terms are governed by French law. In case of dispute, jurisdiction is given to the competent courts of Paris, notwithstanding multiple defendants or third-party claims.
